Terms of service

What Reachcanon does, what it refuses to claim, and where responsibility sits.

Version 2026-10-14

Who you are contracting with

Reachcanon is operated by Nimavera Inc. (in formation), contactable at support@reachcanon.com. Until incorporation completes, the operator is the founder trading as Nimavera; these terms will name the incorporated entity once it exists, and do not name it early.

A postal address for service of notice is available on request at support@reachcanon.com.

A service for organisations

Reachcanon is offered to businesses, public-sector bodies and the people who work for them, not to consumers. By creating an account you confirm that you are acting for an organisation and that you are authorised to accept these terms on its behalf; "you" then means that organisation.

The service

Reachcanon crawls pages you nominate, runs automated accessibility tests against them in a real browser, maps each result to a WCAG success criterion and, where one exists, an EN 301 549 clause, and retains that record so it can be produced later. It can draft an accessibility statement from a scan. It does not fix your website, and it does not act on your behalf.

Reachcanon does not certify anything

Reachcanon is not a conformity assessment body, a notified body, or an auditor. Nothing it produces is a certificate, a mark of conformance, or a determination that your service complies with the European Accessibility Act, EN 301 549, WCAG, or any other standard or law. Reports describe what automated tests observed at a point in time, and nothing more.

Automated testing is partial, and the responsibility stays with you

Automated testing reaches roughly a third of accessibility failures. A result with no detected failures is not evidence of conformance, and an absence of findings in a category is not evidence that the category was satisfied — it may mean the check could not be decided, or that nothing on the page was testable. You remain solely responsible for the accessibility of your service and for any statement you publish about it.

AI-generated guidance can be wrong

Suggested remediation is generated by a large language model. It can be incorrect, incomplete, out of date, or inapplicable to your codebase, and it may describe a change that introduces a different defect. Review it before acting on it, and test the result. Reachcanon does not warrant that following any suggestion will resolve a finding or improve accessibility.

Nothing here is legal advice

Whether your organisation falls within the scope of the European Accessibility Act, which obligations apply to it, whether a disproportionate-burden claim is defensible, and what you must publish are legal questions. Reachcanon does not answer them and is not a substitute for advice from a qualified lawyer in your jurisdiction. Statement drafts are starting points you must review, correct, and take responsibility for.

Scan only what you are authorised to scan

You may submit a site for scanning only where you own it or are authorised by its owner to test it. Reachcanon honours robots.txt, rate-limits requests, and identifies itself in its user agent, but you are responsible for having the right to test the target. Do not use Reachcanon to probe a third party's infrastructure, to generate unsolicited compliance demands, or to publish claims about a site you do not control.

Detection is best-effort, and coverage is a sample

Reachcanon does not warrant that it will detect every accessibility failure on your service, nor that everything it reports is a failure in context. A rule engine can miss a genuine problem and can flag something a person would judge acceptable; measurements taken from rendered pixels are approximations of what a browser painted at one moment. Coverage is limited to the pages the crawler could reach within your plan's page limit and your site's own robots policy, and to areas for which you supplied access — anything not reached is unassessed, not compliant. You must not represent a Reachcanon report as establishing that your service is accessible or complete.

Service is provided as is, and liability is limited

The service is provided without warranty of any kind, express or implied, including fitness for a particular purpose. To the maximum extent permitted by law, Reachcanon and Nimavera Inc. (in formation) are not liable for indirect, incidental, special, or consequential loss, nor for lost profits, lost data, regulatory penalties, or claims brought by third parties. Total aggregate liability is limited to the fees you paid in the twelve months before the event giving rise to the claim. Nothing in this clause limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud. Statutory rights of consumers in the EU are unaffected.

Your account

You are responsible for the security of your credentials and for activity under your account. Tell us promptly at support@reachcanon.com if you believe an account has been compromised. You can turn on two-step verification for your account in Profile → Security; our platform administrators are required to use it. An administrator may deactivate an account; deactivation prevents sign-in and preserves the audit record, because deleting the record of who decided what would defeat the purpose of the product.

Plans, prices and tax

Paid plans are monthly subscriptions, priced in euros and billed in advance through our payment processor, Stripe. Each plan states its ceilings on the pricing page — sites, scan cadence, pages per scan, manual scans and months of history — and they are enforced as published. No plan is unlimited, and nothing is billed as overage: when a limit is reached the service says so and stops at it.

Prices are shown excluding VAT and other taxes. Where tax applies, it is calculated at checkout from the billing address and any VAT or tax number you give, and shown before you pay. You are responsible for the taxes that apply to your purchase. Reachcanon never stores full card details; Stripe holds them.

Renewal and failed payments

A subscription renews automatically each month until it is cancelled, and you authorise Stripe to charge the payment method on file at each renewal. If a renewal payment fails, Stripe retries it; while the payment is outstanding the workspace runs on the Free plan, and it returns to the paid plan as soon as the payment succeeds. If the payment cannot be collected, the subscription ends.

Cancellation

A workspace owner can cancel at any time from the Billing page or the billing portal; no message to support is needed. Cancellation takes effect at the end of the period already paid: the plan stays in force until then, nothing further is charged, and the cancellation can be withdrawn until that date. Afterwards the workspace moves to the Free plan. Scan history older than the Free plan's window is removed after a 30-day grace period; the latest scan of each site is always kept, and everything can be exported before then.

Changing plan

Plan changes are made in the billing portal, on the same subscription; a second subscription is never created. Stripe prorates the change: moving to a dearer plan charges the difference for the rest of the current period, and moving to a cheaper one credits the unused time against later invoices. Credits are applied to future invoices, not paid out.

Refunds

Fees are paid in advance for a period you keep access to, so they are not refunded, in whole or for part of a month, once that period has started. We will refund a charge where you were billed twice for the same period, where you were billed after a cancellation took effect, where a billing error was ours, or where the law requires it. Refunds go back to the original payment method. Write to support@reachcanon.com.

Price changes

We will tell you by email at least 30 days before a price increase applies to your subscription. If you do not accept it, cancel before your next renewal and the old price applies until the end of the paid period.

Data processing

When you add sites, invite team members or give Reachcanon credentials for scanning behind a sign-in, we process personal data on your behalf. That processing is governed by the data processing agreement at /legal/dpa, which forms part of these terms and needs no separate signature.

Ending the agreement

You may stop using Reachcanon at any time and delete your sites, which deletes their scans, findings and statements. We may suspend an account that scans targets it has no right to test, that attempts to circumvent the rate limits, or that uses the service to pursue unsolicited compliance demands against third parties.

Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Subject to mandatory applicable law, the parties submit to the exclusive jurisdiction of the state and federal courts located in New Castle County, Delaware for any dispute arising out of or relating to the service or these terms. If your organisation is established in the European Economic Area, the United Kingdom or another jurisdiction whose mandatory law applies to you, nothing here deprives you of the protection of that law, including the General Data Protection Regulation, or of any right that law gives you to bring proceedings in your local courts.

Changes to these terms

We will tell you by email at least 30 days before a material change to these terms takes effect; if you do not accept it, you may cancel before then. The version you accepted is recorded against your account, and the current version and date are shown at the top of this page.

You accept these terms and the data processing agreement when you create an account, by ticking a box; the version you accepted (2026-10-14) is recorded against your account.
